9. RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify, which enables us to provide the Services. Your transactions are with Orchard Velour (Markedspace LLC), not Shopify. Shopify is not responsible for sales between you and Orchard Velour and is not liable for any injury, damage, or loss resulting from products or services you purchase from us. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us.
10. PRIVACY

To the fullest extent permitted by law, Orchard Velour (Markedspace LLC), Shopify, and our respective affiliates, officers, employees, agents, contractors, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, revenue, savings, or data) arising from or related to your use of the Services or products, even if advised of the possibility. Our total liability to you for any claim will not exceed the amount you paid for the product(s) at issue, or USD $100, whichever is greater.

You agree to indemnify, defend, and hold harmless Orchard Velour (Markedspace LLC), Shopify, and our affiliates, officers, directors, employees, agents, licensors, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, violation of law, or misuse of the Services/products.

If any provision of these Terms is held unlawful, void, or unenforceable, that portion will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

21. GOVERNING LAW
These Terms and any disputes arising from or relating to them or the Services will be governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. You consent to exclusive jurisdiction and venue in the state or federal courts located in Hillsborough County, Florida.
